Introduction
This Acceptable Use Policy (AUP) is intended to protect LexiStar Alliance customers, and the wider internet community, from inappropriate use of the internet. It applies to anyone using LexiStar services in any of our markets. Your use of our services constitutes acceptance of this AUP. We reserve the right to revise and update it from time to time, and we expect customers to cooperate with our abuse team when asked to assist in an investigation.
General violations
You must not do, or allow anyone else to do, any of the following in relation to our services and equipment:
- Breach any applicable law, commit fraud or any other criminal offence;
- Send, upload, download or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or which breaches copyright, confidence, privacy or any other rights;
- Send unsolicited advertising or promotional material (“spam”), or knowingly receive responses to spam sent by a third party;
- Use the services or equipment in a way that could harm them, our network, our reputation or our other customers;
- Copy or modify our software unless you are legally allowed to;
- Circumvent any security measures in the services;
- Perform unauthorised IP or port multicasting, spoofing, broadcasting, filtering, translation or routing;
- Resell any LexiStar service without our written authorisation.
If you breach this policy we may, at our sole discretion and without notice or refund, suspend or terminate your service, make an additional charge, or block access to any part of the services or equipment.
Network disruptions
Any activity which adversely affects the ability of other people or systems to use our services or the internet is prohibited. This includes denial-of-service (DoS) attacks against another network host or individual user, and any interference with or disruption of the network, network services or network equipment.
It is your responsibility to ensure your own network is configured securely. Running an unsecured Wi-Fi network, or allowing others to use your connection, could lead to you being held legally responsible for third-party misuse of your service. We reserve the right to run network scans to help find and fix issues covered by this policy, for example if we believe a device on your connection is vulnerable to malware.
Excessive bandwidth
All plans include unlimited data. However, if we reasonably determine that a pattern of use is adversely affecting our ability to provide service to others, we may take immediate corrective action. We will attempt to notify the account owner as soon as possible.
We do not tolerate, endorse or participate in email spamming. Sending unsolicited commercial email, or large volumes of unsolicited email of any kind, is prohibited. Solicited mailings must be confirmed through a double opt-in list, recipients must be able to unsubscribe easily, and users operating mail servers must ensure they are not open relays. Anonymous bulk mail will lead to suspension or termination of the account, which may happen without notice.
Copyright infringement
All material published through our services must be owned by the publisher, or the appropriate releases must have been obtained prior to publishing. We cooperate with all agencies attempting to assert their rights in these matters.
Reporting violations
Anyone who believes there is a violation of this AUP should send the details to our abuse team at info@lexistaralliance.com. Please include:
- The IP address used to commit the alleged violation;
- The date and time of the alleged violation, including the time zone;
- Evidence of the alleged violation — emails with full header information, syslog files and firewall logs all provide the required detail.
In response to complaints we may issue warnings, suspend or terminate the customer’s account, or invoice the customer for administrative and reactivation costs.
